INTRODUCTION
These are the terms and conditions upon which each subsidiary of The Boot Warehouse – Franchise or their respective Agents, sell and quote for the sale of goods.
AGREEMENT WITH OUR CUSTOMERS

If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.
PRICING AND GST
The parties agree that:
(a) the Purchase Price is inclusive of GST.
(b) all other Payments have been calculated without regard to GST.
(c) each party will comply with its obligations under the Competition and Consumer Act 2010 (Cth) when calculating the amount of any Payment and the amount of any relevant Payments will be adjusted accordingly.
(d) if the whole or any part of any Payment is the consideration for a Taxable Supply (other than for payment of the Purchase Price) for which the payee is liable to GST, the payer must pay to the payee an additional amount equal to the GST Amount, either concurrently with that Payment or as otherwise agreed in writing.
(e) any reference to a cost or expense in these terms and conditions excludes any amount in respect of GST forming part of the relevant cost or expense when incurred by the relevant party for which that party can claim an Input Tax Credit; and the payee will provide to the payer a Tax Invoice.
Product Description and Colours
We have done our best to display as accurately as possible the description and colour of the products shown on this web site. However, we rely on information provided to us by our suppliers and because the colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate.
ACCEPTANCE OF GOODS
The Buyer shall inspect all goods upon delivery and shall within one (1) Business Days of delivery give notice to the Seller named in the relevant Sales Invoice or of any matter or thing by which the Buyer alleges that the goods are not in accordance with the Buyer’s order. Failing such notice, subject to any non-excludable condition implied by law, such as those in the Competition and Consumer Act 2010 (Cth), the goods shall be deemed to have been delivered to and accepted by the Buyer.
FRAUD CHECK
As an online only company, we try our best to ensure that we always maintain a safe and secure environment for our customers. For this reason, we randomly select orders to be checked for fraud. This process involves us refunding a small amount back into your account via credit card you used for your purchase. We will email you requesting you to confirm this amount. Once the exact amount has been confirmed we will send your order out by express to ensure your order did not suffer a delay. If the amount has not been confirmed within 5 business days your order will be cancelled. The use of our website gives us permission to potentially select your order.

Permission to use documents delivered from this World Wide Web site and/or server and related graphics is restricted. Our name (The Boot Warehouse) or any trademark or logo appearing on the website may not be used in advertising or publicity pertaining to distribution of this information without specific, written prior permission from us or the owner of the same. The information contained in this website is subject to change without notice. We are not responsible for typographical, technical, or descriptive errors of products herein.

CUSTOMER COMMUNICATIONS
The Boot Warehouse will communicate with you about your order by email and phone. By registering or ordering on The Boot Warehouse you grant us the right to add your contact details to our database. From time to time we may send you marketing material about offers and new products. ORDER ACCEPTANCE
Your receipt of an electronic or other order confirmation does not signify our acceptance of your order or our offer to sell. The Boot Warehouse reserves the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment. We may require additional verifications or information before accepting any order.
ORDER CANCELLATION
You may cancel you order before the order is dispatched by The Boot Warehouse and we will refund you in full for the orders cancelled. We will not charge you a cancellation fee. However, once the order is dispatched for delivery you are unable to cancel the order but may return the order as outlined in our Returns Policy HERE
The Boot Warehouse reserves the right to cancel your order if we are unable to process payment on the credit card provided or you provide unauthorised payment details; if the personal details you provide are invalid; or if, when required you are not able to provide satisfactory proof of identity. In addition, The Boot Warehouse reserves the right to cancel your order if the product has become unavailable or if, for any reason, we believe we cannot successfully complete delivery.
The Boot Warehouse will attempt to notify you before cancelling your order.
ACCOUNT SUSPENSION AND TERMINATION
The Boot Warehouse reserves the right to suspend or terminate your account at any time without prior notice to you, if you breach these Terms and Conditions. If your account is suspended or terminated, you will not be able to access the Website.
In the event of Account Suspension or Termination and you are waiting delivery of products, The Boot Warehouse reserves the right to cancel your order. A refund may be issued to the credit card provided during the purchase process.
DELIVERY
The Boot Warehouse offers shipping within Australia as detailed within our shipping details which you can read HERE. The delivery times provided are estimates only.
It might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your order and arrange for cancellation of the order or delivery to an alternative delivery address.
We deliver in our standard packaging. Any special packaging requested by you is subject to additional charges.
The Boot Warehouse will not be accountable for late deliveries or loss or for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
RETURNS AND REFUNDS
You may return items purchased at The Boot Warehouse for a full refund within 30 days of purchase. To qualify for a full refund items must be in an unworn, undamaged and unmarked condition and in their original undamaged packaging and labelling.
Upon receipt of the product, you may choose to return the product to The Boot Warehouse for a full refund if the product is faulty when you receive it. Faults will be assessed by our Customer Service Team and we may also consult with the supplier and/or manufacturer. If the product is found to be faulty you will receive a full refund, otherwise the product will be returned to you.
Refunds will be issued in accordance with our Returns Policy and will only be made to the original account used for payment. In some limited circumstances we may make a refund to an alternate account if the original has been cancelled or is not available. The Boot Warehouse will not consider requests for refunds after 30 days of purchase, unless the product is deemed faulty by our Customer Service Team.

LOSS OF GOODS
The risk of loss of goods shall be passed to you upon our delivery of the product to The Boot Warehouse nominated delivery company. The Boot Warehouse will not be held responsible for any loss, damage or liability as a result of this authority.
WARRANTIES
It is your responsibility to ensure that the products purchased are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the products will meet your individual requirements.
All warranties offered are the manufacturer’s warranties and not that of The Boot Warehouse
PROMOTIONS
The Boot Warehouse may use promotional vouchers or coupons for products on the site. If you have a promotional voucher, that voucher can be used by someone other than you and you can assign your rights to use that voucher. The value and expiry is specified on the voucher. Vouchers may only be redeemed once during checkout on The Boot Wareouse and by clicking “Apply Coupon”.
Vouchers CANNOT be used in conjunction with other promotional vouchers, used on sale items or redeemed for cash. Individual brands may be excluded from voucher promotions.
If you place an order for a product less than the value of the promotional voucher, no refund or residual credit will be returned to you.
Furthermore, if the credit of a promotional voucher is insufficient for the order you wish to make, you may make up the difference through payment.
Fixed dollar discount coupons can only be applied to orders of $30 or more.
DISPUTES
Your satisfaction is important to us and we welcome your feedback – good and bad. If you have a complaint please let us know via our Contact Us page HERE. We will try to address your concerns as soon as reasonably possible and will contact you on receipt of any relevant enquiry or complaint. In some cases, the manufacturer or other third party may be involved, and as such it may take longer to resolve such an enquiry or complaint.
In the event of a complaint it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, send us copies of the order or at least the order number that we assign you in the Acknowledgement or Confirmation of Order. Should you not have received any reaction from us within five business days, please make further enquiries. Very occasionally your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you. We strive to offer out customer the best experience but sometimes mistakes may occur and we understand this may frustrate some customers. We welcome your feedback, but we will not communicate with customers who swear or use foul language. In this case we will disconnect your call or not be in reply.
REVIEWS AND COMMENTS
You may post reviews or make comments on the content of our Website. Any content must not be illegal, obscene, threatening, defamatory, infringing of intellectual property rights, invasive of privacy, or otherwise objectionable to third parties and is not permitted to consist of or contain software viruses, commercial solicitation, mass mailings, or any form of “spam.” The Boot Warehouse reserves the right to remove such content at any time, and without notice to you.
If you post content, and unless we indicate otherwise, you grant The Boot Warehouse a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, distribute, and display such content on its website and on any other marketing material The Boot Warehouse may create.

The Boot Warehouse shall endeavour to ensure that any advertising contained on the site shall comply with any relevant regulations published by the Advertising Standards Authority.
The website may contain links to other websites on the Internet that are owned and operated by The Boot Warehouse + Hytech Pty Ltd. You acknowledge that we are not responsible for the operation of or content located on or through any such site.
CLEARANCE ITEMS
Please note any items marked as CLEARANCE on our website are final and cannot be returned for a refund or exchange, unless the item received is faulty or incorrect.
